Bio-Medical Waste (Management & Handling) Rules,1998

 

 

PURPOSE:

 

  1. For proper management & Handling of bio-medical waste.
  2. Applicable to all persons who generate, collect, receive, store, transport, treat, dispose or handle bio-medical waste in any form.

 

 

PROVISIONS:

As per Rule 8 of The Bio – Medical Waste ( Management and Handling) Rules, 1998, as amended to date, , every occupier of an institution generating, collecting, receiving, storing, transporting, treating, disposing and/or handling bio-medical waste in any other manner, except such occupier of clinics, dispensaries, pathological laboratories, blood banks providing treatment / service to less than 1000 (one thousand) patients per month, shall make an application in Form I to the prescribed authority for grant of authorization.

 

As per Rule 7 of the said BMW Rules, State Pollution Control Boards in respect of States and the Pollution Control Committees in respect of Union Territories are the Prescribed Authorities. ( Delhi Pollution Control Committee in case of Delhi )

SEGREGATION & COLOUR CODING

Yellow: Human Anotomical Waste(Human Tissues, organs,body parts),Animal Waste (Tissues, organs,body parts, Carcasses etc.), Microbiology and Bio- technology Waste,Soiled Waste( Waste Category 1,2 and 3&6)

 

Red: Microbiology and Biotechnology Waste((Waste Category 3), Soiled Waste(Waste Category 6) , Solid Waste ( Waste Category 7)

 

Blue/White: Waste Sharps(Waste Category 4)& Solid Waste (waste Category 7)

 

Black: Discarded medicines & Cytotoxic Drugs((Waste Category 5), Incineration Ash((Waste Category 9) and Chemical Waste [ Waste Category 10(solid) ]

 

BMW Containers/Bags /Storage Facility must have proper Labels( Bio- Hazard/ Cyto Toxic Hazard Symbol) as prescribed in Schedule III of the Rules.

Hospitals which are connected to sewer& STP are required to meet the prescribed General standards under EPA.

DPCC has taken decision that Hospital having 500 beds or more shall install ETP for the treatment of waste water generated and for the use of treated water for the purpose other than potable use.

 

 

HOW TO APPLY

Application in Form – I under BMW Rules.

Prescribed fee: - (minimum 3 years fee as given below)

  1. Clinics, Path Labs and Blood Banks Rs. 1000/-per annum.
  2. Vet.Instt., Dispensaries & Animal Houses Rs. 1000/- per annum.
  3. Hospitals,Nursing Homes &HCUs upto 4 bedsRs. 1000/- per annum and at Rs. 100 per additional bed per annum.
  4. Operator of facility of BMW Rs.10,000/-per annum.
  5. Transporter of BMW Rs .7500/-per annum

Affidavit in prescribed proforma regarding Complince w.r.t. BMW Rules

Copy of Valid Agreement with Common Operator of BMW Facility.

Advisory Committee has been constituted under Bio-medical Waste (M &H) Rules for its effective implementation.

Appellate Authority under BMW Rules –

Appeal, if any, to be filed with in 30 days from the date of receipt of the Aggrieved Order .

Requirements Under Air Act

As per the Provisions of the Air ( Prevention and Control of Pollution) Act,1981, Units having Boiler/ Any other Air Pollution Source(Fuel Burning) or having DG Set are required to Apply for the Consent (to Establish for establishing the unit) and for Consent to Operate (for operation of the Unit)under the provisions of the said Air Act.

Units having DG Set are also required to provide Acoustic Enclosure or treat the Room Acoustically to meet the norms prescribed by MOEF and also to provide proper stack height for DG Sets as prescribed by MOEF.

 

 

Meeting of Pr. Secy(Health)on 25.09.07

Following main decisions were taken in the Meeting of Pr. Secy(Health) on 25.09.07

Each Hospital/ Health Care Unit to Designate one Nodal Officer to Deal with all the matters/ issues related with management of BMW

Initiatives/ measures will be taken for phasing out of mercury based equipments e.g. thermometers & B.P.Instruments.

Hospitals having 500 beds or more will install ETP, as decided by DPCC for the reuse of the treated waste water.

 

 

Activities of Bio- Medical Waste Management Cell :

The Cell carries out all the activities pertaining to this cell for the implementation of the aforementioned Rules & activities.

This cell also deals with Batteries (Management & Handling ) Rules 2001 and Mercury Waste

As per Office Order Dated 25.04.2008 , One Sr. Env. Engineer , One Env. Engineer and two Asstt. Env. Engineers , have been deputed in this cell.

(For Hospitals / Nursing Homes etc. having bed strength 50 and above and transporters and Operators of Co mmon Bio Medical Waste Treatment Facilities.)

 

This committee is headed by Chairman , DPCC and having Member Secretary, DPCC, Dr. T.K.Joshi,COEH , Dr. Chetna Harjai, Scientist , Deptt of Environment , Govt. of Delhi, concerned EE & AEEs of BMW as members.

 

Committee No. 2

(For Hospitals / Dispensaries / Clinics etc. having bed strength between 10 to 49.) .

This committee is headed by Member Secretary , DPCC, and having Medical Superintendent, G.B.Hospital , SEE,concerned EE & AEEs of BMW as members..

 

Committee No. 3.

(For Hospitals / Dispensaries / Clinics etc. having bed strength of 9 and below ).

This committee consists of Shri Chander Prakash , SEE , Medical Superintendent, Aruna Asaf Ali Hospital , concerned EE & AEEs of BMW .

The BMW Cell carries out inspections etc as per the decisions taken by the aforementioned 3 Committees and as per the decisions taken by the Chairman & Member Secretary on the various issues pertaining to this Cell.
